Is a match score just keyword matching with a new name?

Features to look for in an AI candidate screening tool

What the law requires of you, not of your vendor

New York City's Local Law 144 took effect on 1 January 2023 and DCWP enforcement began on 5 July 2023. The city's own FAQ is explicit that screening counts as an employment decision, that the bias audit must be done every year by an independent auditor, and that notice goes out 10 business days before you use the tool.

The duty is yours. DCWP states that employers and employment agencies are responsible for ensuring a bias audit was done, and that the vendor who created the tool is not responsible for auditing it. A vendor may commission an independent audit of its own tool, which helps, but it does not transfer the obligation.

The federal yardstick is the four-fifths rule: a selection rate below four-fifths of the highest group's rate "will generally be regarded by the Federal enforcement agencies as evidence of adverse impact". A carve-out worth knowing

DCWP says the notice and audit rules apply to assessing candidates who have applied for a specific position. Scanning a resume bank or reaching out to someone who has not applied sits outside them. Anti-discrimination law still applies everywhere.
